1. Introduction

These Terms and Conditions ("Terms") govern your use of the Dr DS Grieve website and the medical services provided by Dr D.S. Grieve ("we", "us", or "our"), including:

•In-practice aesthetic and medical services delivered at our Centurion clinic (Botox, dermal fillers, Profhilo, threads, bio-collagen stimulators, hormone consultations, women's and men's wellness, PRP, and related treatments).

•The Dr DS Grieve telemedicine-enabled medical weight-loss programme using GLP-1 and GLP-1+GIP therapies (Semaglutide and Tirzepatide) under the supervision of a registered medical practitioner.

By accessing or using any of these services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the services. All services are provided in accordance with the Health Professions Council of South Africa (HPCSA) regulations and, where applicable, telemedicine guidelines.

2. Eligibility

You must meet all of the following criteria to use the App:

•Be at least 18 years of age

•Be a South African resident with a valid South African ID number

•Not have any absolute contraindications to GLP-1 therapy as determined during onboarding

•Provide accurate, complete, and current information during registration and onboarding

•Not be currently prescribed GLP-1 therapy by another medical provider without disclosure

3. Medical Disclaimer

The App provides medical weight-loss services through a licensed South African medical practitioner (HPCSA Registration No. 0466352, Practice No. 1562207). However:

•The App does not replace an in-person consultation for emergency or urgent medical conditions.

•If you experience a medical emergency, call 10177 (ambulance) or proceed to your nearest emergency room immediately.

•GLP-1 medications carry risks and side effects that are disclosed during onboarding and in your prescribed treatment plan. You are responsible for reading and understanding these.

•Results of treatment vary. Weight loss outcomes are not guaranteed and depend on adherence to treatment, lifestyle factors, and individual physiology.

•You must disclose all current medications, conditions, and allergies accurately. Failure to do so may result in harm and the termination of your treatment.

4. Services and Fees

The App facilitates the following services, subject to applicable fees:

•Initial Consultation (R600): A medical screening and assessment by Dr D.S. Grieve to determine suitability for GLP-1 therapy. This fee is non-refundable once the consultation has been reviewed.

•Medication Orders: Purchase of prescribed GLP-1 medications through the App. Pricing is displayed at the time of order.

•Delivery Fees: Applicable delivery charges are shown at checkout based on your delivery address (Gauteng or national rates).

All prices are quoted in South African Rand (ZAR) and include VAT where applicable. Payments are processed securely via PayFast. We do not store your payment card details.

5. Prescriptions and Dispensing

Medications are prescribed by Dr D.S. Grieve and may only be dispensed after:

•Successful completion of medical screening and onboarding

•Payment of the initial consultation fee

•Clinical review and approval of your application by the prescribing doctor

Prescriptions are generated digitally and stored securely within the App in accordance with HPCSA telemedicine regulations. You may request a copy of your prescription at any time through the App.

The prescribing doctor reserves the right to decline to prescribe medication at their clinical discretion without liability.

6. Your Responsibilities

You agree to:

•Provide accurate and truthful medical information at all times

•Notify us immediately of any adverse reactions or side effects by contacting support

•Submit monthly check-ins as requested to ensure safe ongoing treatment

•Log your injections accurately to support clinical monitoring

•Not share your account credentials with any other person

•Not use the App for any unlawful purpose or in violation of these Terms

•Keep your contact details (email, phone) up to date in your profile

7. Prohibited Uses

You may not:

•Use the App to obtain medications for resale or distribution to others

•Provide false medical history to obtain prescriptions

•Attempt to circumvent the contraindication screening process

•Access the App using another person's credentials

•Attempt to reverse-engineer, decompile, or tamper with the App

•Use automated tools or bots to interact with the App

8. Account Suspension and Termination

We reserve the right to suspend or terminate your account with or without notice if:

•You breach these Terms

•You provide false or misleading medical information

•Your continued use of the service poses a clinical risk, as determined by the prescribing doctor

•Your account shows signs of fraudulent activity

You may request deletion of your account at any time through the Profile section of the App. Deletion requests are processed within 30 days. Some data may be retained for legal and regulatory compliance purposes.

9. Intellectual Property

All content within the App, including but not limited to logos, text, graphics, educational material, and software, is the property of Dr D.S. Grieve or its licensors and is protected by applicable South African and international intellectual property laws. You may not reproduce, distribute, or create derivative works without our written consent.

10. Limitation of Liability

To the maximum extent permitted by South African law, we are not liable for:

•Indirect, incidental, or consequential damages arising from your use of the App

•Treatment outcomes, adverse effects, or complications from prescribed medications

•Service interruptions, data loss, or technical failures outside our reasonable control

•Third-party services including payment processors and delivery providers

Our total liability for any claim arising from your use of the App is limited to the amount you paid for the specific service giving rise to the claim in the 3 months preceding the claim.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the South African courts.

You agree to attempt to resolve any dispute informally by contacting us at support@drdsgrieve.co.za before initiating formal legal proceedings.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the App or via email at least 3 days before they take effect. Continued use of the App after changes take effect constitutes your acceptance of the revised Terms.
